Terms of Use

These terms cover use of the Downing Creates website. A separate written project agreement governs any website project you hire us to complete.

Important distinction

Submitting an inquiry does not purchase a service or require either party to proceed. Project scope, timing, payment, revisions, ownership, cancellation, and support are confirmed in a separate written agreement.

1. Acceptance of these terms

By using this website, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the website or submit information through it.

2. Website information and inquiries

The website provides general information about Downing Creates, example design concepts, services, pricing, and the project process. Portfolio concepts are examples and are not represented as completed client work unless clearly identified otherwise.

A form submission is only a request for a conversation or free homepage preview. It does not create a client relationship, guarantee availability, reserve a start date, or require Downing Creates to accept a project.

3. Pricing, scope, and payment

Posted package prices describe the standard scope shown on the website. The Basic Website is listed at $250 and the Premium Website at $500, each split into a 50% initial payment and 50% final payment. Add-ons, unusual requirements, third-party costs, or work outside the listed package may require a separate written price approved before that work begins.

Before paid work begins, the parties should confirm the selected package, deliverables, responsibilities, schedule, revision allowance, payment terms, cancellation terms, and any special requirements in writing. Stripe Payment Links may be used for secure payment processing. Payment does not add work or rights beyond the written project agreement.

4. Client projects

Client projects are governed by the signed project agreement and any written scope changes. If these website terms conflict with a signed project agreement, the signed project agreement controls for that project.

Clients are responsible for providing accurate information, timely feedback, approved content and images, and permission to use any materials they supply.

5. Intellectual property

The Downing Creates name, website design, website copy, logos, graphics, example concepts, and other site materials are owned by Downing Creates or used with permission and may not be copied, sold, republished, or presented as your own without written permission.

Ownership and usage rights for a paid client website are set by the applicable project agreement.

6. Acceptable use

You may not misuse the website, attempt unauthorized access, interfere with site operation, submit malicious code, impersonate another person or business, send unlawful or abusive material, scrape the site in a way that harms its operation, or use the site to violate another party’s rights.

7. Third-party services and links

The website may use or link to services operated by third parties, including Netlify and Stripe. Downing Creates does not control every aspect of those services. Your use of a third-party service is also subject to that provider’s terms and privacy practices.

8. Disclaimers and limitation

The website is provided on an “as available” basis. While we work to keep information accurate and the site available, we do not guarantee that every page will always be uninterrupted, error-free, or suitable for every purpose.

To the extent permitted by law, Downing Creates is not liable for indirect, incidental, special, or consequential losses arising solely from use of this informational website or reliance on its general content. Nothing in these terms excludes rights or responsibilities that cannot legally be excluded.

9. Changes

We may update the website and these terms from time to time. The date at the top of this page shows the latest revision. Continued use after an update means the revised terms apply to future website use.
